MassageLuXe Privacy Policy
The MassageLuXe Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by Massage Luxe International, LLC (“we,” “us,” “our,” or “MassageLuXe”).
This Privacy Policy, along with our Terms of Use governs your use of the MassageLuXe website at https://massageluxe.com/ (the “Site”), and any information we may access through our social media platforms such as Facebook, Instagram, or LinkedIn. For the purposes of this Privacy Policy, we will refer to these access points as the MasageLuXe system (the “System”).
The Privacy Policy discloses the ways we collect, share, and use your Personal Information. Personal Information means any identifying information, such as your name, postal address, email address and telephone number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.
We may update this policy from time to time and will mark new versions with a corresponding effective date. We recommend you visit the Site to review any changes in our practices. Your continued use of the System constitutes your agreement to our then-current Privacy Policy.
What Information is Collected?
Information Collected Directly from You
We may collect Personal Information about you when you sign up for a mailing list, fill out a “Contact Us” form, apply for a job via our Site, request information about owning a MassageLuXe franchise, submit information in connection with a purchase, or as part of other online services. The lawful basis for collection of this information is based on your consent, MassageLuXe’s legitimate interest, or as necessary to fulfill a contract with you.
The information we may collect includes, but may not be limited to:
- Name, email address, phone number, mailing address, and other location or contact information
• Financial information necessary to process a purchase or other request such as a franchise application; and
• Personal Information and other information you voluntarily submit through the System.
Information Collected Automatically
To provide you with services, complete your requests and maintain a functional System, we may automatically collect certain information when you visit or navigate the Site, including:
- Location, date and time you access the System, and IP addresses to measure our website traffic and to help provide a more personalized experience;
• Your browser type and other technical specifications such as device ID, hardware/software type, internet service provider, serving domains;
• Your search and transaction history relating to the use of our products and services;
• Files that allow us to “recognize” you when you navigate the Site, to credit your account for online transactions and collect data such as analytics, page views, targeting data, ad views, and interaction data; and

Collecting Information from Children Under the Age of 13
Our Site and System are not designed for or targeted toward children, and we do not knowingly collect, maintain, or use Personal Information from any person under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we may delete such information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information on our System without their permission. How Is the Information We Collect Used?
We collect information about you in order to provide you with services and products, and to make the System work properly. We use Personal Information for a variety of purposes related to our business, including but not limited to:

Performing the essential functions of the System including responding to inquiries, fulfilling orders and requests, processing payments, providing support and troubleshooting, data aggregation, analysis and report creation to assess marketing effectiveness and/or business performance, and communicating with users about their use of the System or responding to a user-initiated inquiry on the System.

Sending or initiating direct marketing programs, such as newsletters or information about products or services we are offering; using content from social media platforms where users discuss our services or use a hashtag related to our services.

Tailoring content on the System based on user location, preferences, and other personalization factors.
Analytics and System improvement
Tracking information about your visits to our Site or use of the System to allow us to provide better service, using certain online preferences in the aggregate across all users to evaluate the System and develop additional products and services to offer.

We may share your information with MassageLuXe franchisees and others as set forth in this Privacy Policy, as indicated below.
We may share non-individual information, in the aggregate, regarding your online browsing preferences to evaluate our services or to allow the service providers with whom we work to better serve our users.
We may provide user information to our franchisees, service providers or vendors for reasons such as:
- Scheduling, managing services and appointments
- Initiating direct marketing programs on our or a franchisee’s behalf,

• Maintenance or development of our System,
• Development of online products, services, or customer service, or new product development,
• Other contracted promotional opportunities provided to our users relating to our products and services.

We may also disclose your information to a third party as part of reorganization or a sale of the assets of MassageLuxe, or its subsidiaries or divisions. Any third party to which MassageLuxe transfers or sells the System or related assets will have the right to continue to use the personal and other information that you provide to us. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.
Text Messaging
We may share your Personal Data, including your SMS opt-in or consent status, with our brand franchisees and third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign.
Cookies and Similar Technologies
We use cookies, pixels, and similar technologies to gather information about your use of our System and to customize your experience using the System.
Cookies

Pixels and other Tracking Technologies

Pixels are small transparent images embedded in a site, email or ad and may provide information to platforms such as Google, Meta or TikTok, who may combine your information with other information they have about you.
Google Analytics
We use Google Analytics to help create reports and statistics on the performance of the Site. Google Analytics collects information such as your IP address, device type and operating system, referring URLs, location and pages visited. If you do not want Google Analytics to be used in your browser, you can install the “Google Analytics Opt-Out Browser Add-On,” provided by Google.
Marketing Communications
You have the right to opt-out of marketing communications we send you.
If you no longer want to receive marketing-related emails from us, you can opt-out of receiving such emails by clicking the “unsubscribe” link at the bottom of any marketing email you receive from us. Please be aware that you will continue to receive certain communications from us that are necessary for our services. Surveys & Contests
From time-to-time our site requests information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.
Third Party Websites and Links
Our System may contain links to other websites. These websites may have privacy policies different from our Privacy Policy. The System may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Policy but by the terms of use and privacy policy of the particular platform.
How is User Information Protected?
We make reasonable efforts to maintain administrative, physical, and technical safeguards for all Personal Information collected in our System, designed to protect your Personal Information from unauthorized access and against unlawful processing, accidental loss, destruction and damage. Unfortunately, the transmission of information via the internet is not completely secure, we cannot make any guarantees as to the security or privacy of your Personal Information.
We retain data collected from you only for as long as necessary to complete the purpose for which it was collected.
State Privacy Rights
A number of other US states, may provide their residents with certain privacy rights, if and when applicable.
